On the implementation of the 29 March 2019 and Law of the Republic
of Azerbaijan no. 1555-VQ On Mediation
Governed by the clauses 19 and 32 of Article 109 of the Constitution of
the Republic of Azerbaijan, in order to ensure the implementation of the
present Law on the entry into force of the 29 March 2019 dated Law of the
Republic of Azerbaijan no. 1555-VQ On Mediation, I hereby decree as
follows:
1.
The
Cabinet of Ministers of the Republic of Azerbaijan shall:
1.1. prepare proposals on alignment of laws of the Republic of
Azerbaijan and the acts of the President of the Republic of Azerbaijan with the
Law of the Republic of Azerbaijan On Mediation and submit them to the President
of the Republic of Azerbaijan within a period of three months;
1.2. prepare draft bill on making amendments to the Law of the
Republic of Azerbaijan “On State Duty”, in accordance with the first sentence
of Article 3.4 of the present Law and to submit it to the President of the
Republic of Azerbaijan within a period of
three months;
1.3. prepare draft bill that determines responsibility for the
violation of the present Law and submit it to the President of the Republic of Azerbaijan within a period of three months;
1.4. prepare proposals on the body (institution) stipulated by
Articles 26.3, 26.4 and 26.5 of the present Law and submit them to the President of Republic of Azerbaijan within a period of two months;
1.5. prepare proposals on providing state support for creating the
Mediation Council and submit them to the
President of
Republic of Azerbaijan within a period of two
months;
1.6. confirm the procedure for conducting a mediation registry, in
accordance with Article 15.3 of the present Law and to inform the President of
the Republic of Azerbaijan within a period of three months;
1.7. confirm the training procedure for the preparation of
mediators and the upgrade specialization, in accordance with Article 20.1.5,
25.2, 26.6 and 27.2 of the present Law and to inform the President of the
Republic of Azerbaijan within a period of three months;
1.8. confirm the professional ethical rule of behavior of
mediators, in accordance with Article 20.1.5 of the present Law and to inform
the President of the Republic of Azerbaijan within a period of three months;
1.9. confirm the procedure for execution of the mediation process,
in accordance with Article 20.1.5 of the present Law and to inform the
President of the Republic of Azerbaijan within a period of three months;
1.10. confirm the amount of fees and other expenses for the
provision of mediation services during initial mediation session, in accordance
with Article 36.2 of the present Law and to inform the President of the
Republic of Azerbaijan within a period of three months;
1.11. confirm the procedure for the payment of the mediation costs
at the
expense of the state budget in accordance with the second sentence of Article
36.7 of the present Law and to inform the President of the Republic of Azerbaijan within a period of
three months;
1.12. ensure the alignment of normative legal acts of the Cabinet of
Ministers of the Republic of Azerbaijan with the present Law and to inform the President of the Republic of
Azerbaijan within
a period of three months;
1.13. exercise
control over the alignment of
normative legal acts of the central executive bodies with the present Law and
to inform the President of the Republic of Azerbaijan on its implementation
within a period of five months;
1.14. resolve other issues arising from the present Law.
2. to establish that:
2.1. the authorities of the relevant executive body stipulated by
Article 15.3, 20.1.5, 25.2, 26.3-26.6, 27.2, 36.2 and the second sentence of
the Article 36.7 of the Law of the Republic of Azerbaijan On Mediation are
carried out by the President of the Republic of Azerbaijan;
2.2. the term “body” refers to the Cabinet of Ministers in the
Articles 15.3, 20.1.5, 25.2, 26.6, 27.2, 36.2 and the second sentence of the
Article 36.7 of the present Law.
3. ensure the alignment of normative legal acts and acts of
normative character of the central executive bodies of the Ministry of Justice
of the Republic of Azerbaijan with the Law of the Republic of Azerbaijan On
Mediation and to inform the Cabinet of Ministers of the Republic of Azerbaijan.
