The Minister of Justice of the Republic of Azerbaijan Fikrat Mammadov addressed to the Ministers of Justice of foreign countries regarding the recent military provocation of the Armenian armed forces against Azerbaijan.
The address noted the tragic consequences of the Armenian-Azerbaijani Nagorno-Karabakh conflict, which lasted more than 30 years and had a serious impact on the fate of more than a million people.
There was noted that Armenia, which made territorial claims to Azerbaijan's historical lands, launched a military aggression in the early 1990s and occupied Nagorno-Karabakh and seven surrounding regions, carrying out ethnic cleansing of the Azerbaijani population, turning one million people into refugees and internally displaced persons.
It was noted that, despite the mediation mission of the OSCE Minsk Group on the peaceful settlement of the conflict after achieving a ceasefire in 1994, Armenia has consistently prolonged the peaceful solution of conflict under various pretexts and continued status quo profitable for it by keeping under occupation the other’s lands, it continues to carry out illegal economic activities there and to illegally settle these territories. Hereby, it grossly violates international law, especially the 1949 Geneva Conventions.
At the same time, since the current Armenian leadership came to power, they have been openly disrupting the negotiation process, despite that the problem of Nagorno-Karabakh’s status is a subject of negotiations, they spoke under the slogans "Karabakh is Armenia and the point" and "A new war for new territories", which openly provoked military provocations and war.
Unfortunately, the failure of the international community to react has intensified the military provocations in the border areas, opening the arms of the aggressor.
It was noted in the appeal that the President of the Republic of Azerbaijan, Mr. Ilham Aliyev, during his speech at the 75th session of the UN General Assembly, brought these issues to the attention of the world community in detail and with accurate facts.
The culmination of the events was on the September 27, 2020, when the Armenian armed forces deliberately and purposefully began firing at our military positions and, worst of all, our settlements and civilians with heavy artillery.
As a result of the attack, 27 civilians, including not only our servicemen, but also seven women and three children, have been killed and more than 140 civilians have been injured. In addition, about 450 residential buildings and civil objects,
including a maternity hospital, a kindergarten, a school, a district court building, etc. were destroyed or severely damaged.
It was noted that the President of Azerbaijan, Supreme Commander-in-Chief Ilham Aliyev addressed the nation with relate to the situation on the front line as a result of military aggression and it was noted that, in accordance with Article 51 of the UN Charter, basing on the right of self-defense, our country is forced to conduct counter-offensive operations to force Armenia to peace.
Seeing the successful counterattack of our army, which fought for their native lands and only on their own territory, the Armenian side is firing on peaceful towns and villages with cluster bombs, the use of which is prohibited by international law.
Thus, Ganja city, the second largest and oldest city after the capital, located tens of kilometers far from the line of contact, came under heavy rocket fire. In addition, a missile was fired at the city of Mingachevir, which is a large industrial center and a large water reservoir and energy object, located more than 100 km far from the place of military operations.
The Minister stressed that, these strikes from the territory of Armenia are aimed at provoking our country to retaliate and involve third countries in military operations.
Armenia recruits and uses foreign mercenaries contrary to the international norms, as well as makes calls in the international arena for terrorism and other criminal acts against Azerbaijan, with the widespread use of social networks.
The Prosecutor General's Office of Azerbaijan has reportedly opened dozens of criminal cases in connection with the violation of international humanitarian law in connection with the death of civilians as a result of the shooting and destruction of civilian infrastructure.
There was stressed that, four resolutions of the UN Security Council (822, 853, 874 and 884) demanding the immediate, complete and unconditional withdrawal of the Armenian armed forces from our occupied territories and other similar decisions of the leading international organizations such as the Non-Aligned Movement, the OSCE, the European Parliament and the Organization of Islamic Cooperation should be immediately implemented and the full power of international law to restore justice should be applied.
Taking into account the existing condition as a result of ongoing aggression, the Minister of Justice called to take preventive measures for the implementation of existing international legal mechanisms and the restoration of justice, peace and security, and the prevention of the illegal recruitment of mercenaries and other illegal activities in their countries.
At the end of the appeal, they expressed confidence that as a person responsible for justice and judgement, their colleagues will not be left out of this issue and will take appropriate measures within their powers against unprecedented violations of international law.
