On the implementation of the 23 April
2019 Law of the Republic of Azerbaijan no. 1569-VQD On Amendments to the Law of
the Republic of Azerbaijan On Insolvency and Bankruptcy and On Amendments to the 23 June 1997 Decree of the
President of the Republic of Azerbaijan no. 604 On the Implementation of the Law of the Republic of Azerbaijan On
Insolvency and Bankruptcy
Governed by the clauses 19 and 32 of Article 109 of the Constitution of
the Republic of Azerbaijan, in order to ensure the implementation of the
present Law on the entry into force of the numbered present
Law of the Republic of Azerbaijan, dated 23 April 2019 no. 1569-VQD, On
Amendments to the Law of the Republic of Azerbaijan On Insolvency and
Bankruptcy, I hereby decree as follows:
1. The
Cabinet of Ministers of the Republic of Azerbaijan shall:
1.1. prepare proposals on the alignment of the
laws of the Republic of Azerbaijan and the acts of the President of the
Republic of Azerbaijan with the 23 April 2019 Law of the Republic of Azerbaijan
no. 1569-VQD On making amendments to the Law of the Republic of Azerbaijan On
Insolvency and Bankruptcy and
to submit
them to the President of the Republic of Azerbaijan within a period of three
months;
1.2. ensure that normative legal acts of the Cabinet of
Ministers of the Republic of Azerbaijan are aligned with the present Law and to inform the President of the Republic of
Azerbaijan
within a period of three months;
1.3. exercise
control over the alignment of
normative legal acts of the central executive bodies with the present Law and
to inform the President of the Republic of Azerbaijan on its implementation
within a period of three months;
1.4. resolve other issues arising from the present Law.
2. to replace the full stop at the end of third paragraph of the
second part of the 23
June 1997 and Decree of the President
of the Republic of Azerbaijan no. 604 On the implementation of the Law of the Republic of Azerbaijan On Insolvency and
Bankruptcy (Legislative Digest of
the Republic of Azerbaijan, 1997, Number 6, Article 461; 2001, Number 10,
Article 640; 2006, Number 7, Article 590; 2010, Number 7, Article 610; 2018,
Number 9, Article 1823) with a semicolon and to add the fourth paragraph in the
following content:
“the authorities of the relevant executive body stipulated by
Article 10-1 of the present Law are carried out by the Ministry of Economy of
the Republic of Azerbaijan.”
3. ensure the alignment of normative legal acts and acts of
normative character of the central executive bodies of the Ministry of Justice
of the Republic of Azerbaijan with the Law of the Republic of Azerbaijan On
Amendments to the Law of the Republic of Azerbaijan On Insolvency and
Bankruptcy and to inform the Cabinet of Ministers of the Republic of Azerbaijan.
