“Electronic Auction” Portal
One of the compulsory enforcement measures carried out by enforcement officers in connection with the enforcement of court and other authorities’ decisions is the seizure of the debtor’s property and the enforcement of claims against the property through its sale. Enforcement officers shall seize the debtor’s property no later than one month from the date on which the decision on initiating enforcement proceedings is delivered to the debtor, and in urgent cases, simultaneously with the delivery of the decision. Following this, the debtor’s property is valued in accordance with the Law of the Republic of Azerbaijan “On Mortgage” based on the agreement of the parties or by a court decision. Except in cases where regulated prices apply, the valuation of the debtor’s property shall be carried out by an appraiser in accordance with the Law of the Republic of Azerbaijan “On Valuation Activity”. The enforcement officer shall engage an appraiser who specializes in the field of valuation, has been operating for no less than three years, and has not been convicted of serious or particularly serious crimes, as well as corruption-related crimes, crimes against the interests of public service, or economic crimes. The seized property, except for property withdrawn from circulation or property with restricted circulation under the law, shall be offered to the claimant, regardless of the grounds for seizure, the type of property, or its ownership, unless otherwise provided by the legislation of the Republic of Azerbaijan. If the claimant refuses, the said property shall be sold within three months from the date of the claimant’s refusal. The auction shall be conducted by specialized institutions no later than two months from the date of receipt of the relevant order from the enforcement officer regarding the sale. The procedure for holding the auction is determined by the legislation of the Republic of Azerbaijan.
