“Electronic Auction” Portal
One of the compulsory enforcement actions of bailiffs in connection with the execution of decisions of courts and other bodies is the seizure of the debtor’s property and its sale. Bailiffs seize the debtor’s property no later than 1 month from the date of submission of the decision to initiate enforcement to the debtor, and in urgent cases, simultaneously with the submission of the decision. After that, the debtor’s property is assessed by agreement of the parties or by court decision in accordance with the Law of the Republic of Azerbaijan “On Mortgage”. Also, except for cases where regulated prices are applied, the assessment of the debtor’s property is carried out by an appraiser in accordance with the Law of the Republic of Azerbaijan “On Appraisement Activities”. The enforcement officer must invite an appraiser who is qualified in the field of appraisement and has been working for at least 3 years and has not been convicted of serious or especially serious crimes, as well as corruption crimes and crimes against the interests of service, or crimes in the economic sphere. The property on which the arrest was made, with the exception of property that has been removed from circulation or whose circulation is restricted by law, shall be offered to the claimant, regardless of the reasons for the arrest, the type of property and its ownership, unless otherwise provided for by the legislation of the Republic of Azerbaijan. If the claimant refuses, the property must be sold within three months from the date of the claimant’s refusal. An auction must be held by specialized enterprises no later than two months from the date of receipt of the relevant order from the enforcement officer regarding the sale. The procedure for holding the auction is determined by the legislation of the Republic of Azerbaijan.
