The Ministry of Justice organizes the state registration of civil status acts. This activity is carried out by the Ministry’s General Department of Notary, Registration and Registry.

The regional (city) registration departments of the Ministry of Justice, within their powers, register births, marriages, marriage dissolutions, adoptions, affiliation, changes in name, patronymic and surname, and deaths, change, complete, correct and cancel the registration of civil status acts, restore lost records, maintain act books and issue duplicate certificates.

Areas of activity

Registration of birth

The following documents are required for birth registration:

  1. Identity documents of the parents
  2. Marriage certificate of the parents
  3. Birth certificate of the parents
  4. A document from a medical institution confirming the fact, time and place of birth
  5. If the child was born outside a medical institution, a document issued by a doctor who assisted in the birth or to whom the parents turned after the birth
  6. If the child was stillborn, a document issued by a doctor stating that the child was stillborn
  7. If the child died before the mother left the medical institution, a document issued by a doctor about the birth and death 
  8. For found children, a document stating the child was found, a medical certificate stating the age and sex, as well as the consent or instruction of the guardianship authority regarding the name, patronymic and surname to be given to him
  9. For abandoned children, a document stating the child was abandoned, a medical certificate stating the place, date of birth and sex, as well as the consent or instruction of the guardianship authority regarding the name, patronymic and surname to be given to him
  10. A legally valid court decree on the establishment of the fact of birth 
  11. a doctor’s certificate on the child’s health after the 1-month period specified for birth registration has passed

List of persons who must be present during a registration of birth 

  • parents or one of them
  • if the parents cannot apply for a valid reason, relatives, neighbors, the administration of the medical institution where the child was born, or authorized persons based on a notarized power of attorney
  • Note 1: After the period specified in the legislation has passed, the parents or one of them must apply for registration of the birth
  • Note 2: For registration of the birth of a child born to an unmarried mother, the mother may apply personally or through a representative representing her based on a power of attorney

Local commission for the protection of minors’ affairs and rights

 

If the parents do not apply for birth registration within the 1-month period established by the legislation without good reasons, administrative disciplinary measures shall be applied in accordance with the requirements of the Code of Administrative Offenses of the Republic of Azerbaijan.

The birth shall be registered by the registry office, consular office or representative office of the executive authority at the place chosen by the person who provided the information, and if the fact of birth is established in court, by the place where the court resolution was issued.

State registration of birth may be carried out on the basis of an electronic application without visiting the registry office, consular office or representative office of the executive authority. Depending on the person’s desire, the relevant certificate may be printed from the information system of the Ministry of Justice of the Republic of Azerbaijan, certified by the signature of an official, and submitted on paper. 

 

During electronic birth registration, an electronic certificate is generated in the information system and transmitted to the “MyGov” Electronic Government Portal for placement in the electronic cabinet of the applicant through the Electronic Government Information System.

If the documents necessary for birth registration can be obtained from the relevant state body (institution) through the Electronic Government Information System, those documents or information are not required from the applicant.

In cases where such documents or information cannot be obtained through the Electronic Government Information System, their submission is required from the relevant state body (institution) upon request with the consent of the applicant or is provided by the applicant.

 

Amount of public duty:

No public duty is paid for birth registration and issuance of initial certificates.

Registration of marriage

The documents required for marriage registration are as follows:

  1. written applications of persons wishing to enter into marriage
  2. identity documents of persons wishing to enter into marriage
  3. a document confirming that persons wishing to enter into marriage have undergone a medical examination
  4. if the documents confirming the identity of foreigners or stateless persons do not contain a record of marital status, a certificate of marital status issued by the competent authorities of the country of their citizenship or permanent residence and duly legalized
  5. for previously married persons, a certificate (copy) of the dissolution of marriage or a certificate (copy) of the death of their husband (wife), or a legally effective court resolution on the invalidity of the marriage or an extract from it
  6. a court decision confirming the fact of being in a de facto marital relationship in the event that one of the persons who were in a de facto marital relationship before July 8, 1944 dies or goes missing without notice
  7. a copy of a document confirming the legal presence or residence of foreigners or stateless persons in the territory of the Republic of Azerbaijan
  8. document on payment of public duty

  • Both parties to the marriage

 

Certificates on family members and marital status certified by an electronic signature can be obtained in digital form through “myGov” e-government portal.

Marriage registration is carried out by any registry office, consular office or representative office of the executive power chosen by the parties to the marriage or one of their parents.

If the specified documents can be obtained from the relevant state body (institution) through the Electronic Government Information System, these documents or information are not required from the applicant.

In cases where such documents or information cannot be obtained through the Electronic Government Information System, their submission is required from the relevant state body (institution) upon request with the consent of the applicant or is provided by the applicant.

Note 1: If one or both of the persons wishing to enter into marriage are foreigners or stateless persons, a copy of the document confirming their legal presence or residence in the territory of the Republic of Azerbaijan, as well as a certificate of marital status, must be attached to the application.

Note 2: By the Law No. 1198-VIQD dated June 28, 2024 on Amendments to the Family Code of the Republic of Azerbaijan, the Criminal Code of the Republic of Azerbaijan and the Code of Administrative Offenses of the Republic of Azerbaijan, provisions were added to Article 12 of the Family Code on the prohibition of marriage between children of brothers and (or) sisters who have a common biological grandfather and (or) grandmother, as well as between uncle and niece, aunt and nephew, who have biological relationship.

Notice: Marriage is prohibited between children of brothers and (or) sisters who have a common biological grandfather and (or) grandmother, as well as between uncle and niece, aunt and nephew, who have biological relationship.

 

Amount of public duty:

A public duty of 10 manats must be paid for marriage registration.

Registration of dissolution of marriage

The documents required for registration of a marriage dissolution are as follows:

  1. joint application of spouses who do not have common minor children for the dissolution of marriage
  2. documents confirming the identity of the applicants
  3. regardless of the presence of common minor children, a marriage dissolution is carried out on the basis of the application of the husband (wife) upon submission of the following documents:
    1. a legally effective court resolution on the disappearance of the husband or wife without notice
    2. a legally effective court resolution on the recognition of the husband or wife as incapable
  4. application of the guardian of the husband (wife) who is recognized as legally incapable in court
  5. a legally effective court resolution on the dissolution of marriage
  6. a legally effective court resolution on the recognition of the marriage as invalid
  7. a marriage certificate in the event of a marriage dissolution based on a joint application of the spouses or the application of the husband (wife)
  8. a document on payment of the public duty

 

List of persons who must be present during the registration of the dissolution of marriage:

  1. in case of dissolution of marriage based on a joint application - both husband and wife
  2. in case of dissolution of marriage based on the application of the husband (wife) - husband or wife
  3. in case of dissolution of marriage based on a court decision - husband and wife (jointly or separately)
  4. guardian of the husband (wife) who is recognized as legally incompetent in accordance with the court order
  5. authorized persons based on a notarized power of attorney
  • Dissolution of marriage based on an application is subject to state registration at the registry office and consular office chosen by the spouses or one of them, and dissolution of marriage based on a court decision - at the place where the resolution on this matter was issued. 
  • With the exception of documents that have lost their legal significance as a result of state registration of the dissolution of marriage, if it is possible to obtain the specified documents from the relevant state body (institution) through the Electronic Government Information System, those documents or information are not required from the applicant.
  • In cases where such documents or information cannot be obtained through the Electronic Government Information System, their submission shall be requested from the relevant state body (institution) upon request with the consent of the applicant or shall be provided by the applicant.

 

Amount of public duty:

Based on mutual consent of spouses who do not have common minor children and on the basis of a court resolution (if the resolution does not indicate which of the parties should pay the public duty, from the party that first applied for registration) – 20 manats 

If the other party is a person who has disappeared without a trace or is recognized as incapable in accordance with the established procedure – 2 manats

 

Registration of adoption

The following documents are required for the registration of adoption:

  • joint application of the adoptive parents or one of them
  • documents confirming the identity of the adoptive parents
  • court resolution on adoption
  • birth certificate of the adopted child

 

List of persons who must be present during the registration of adoption:

  1. adoptive parent - male or female
  2. adoptive parents - male and female
  3. authorized persons based on a notarized power of attorney

 

  • State registration of adoption is carried out by the registry office and consular office at the place where the resolution was issued, based on the court resolution on adoption.
  • In accordance with the Article 118.20 of the Family Code of the Republic of Azerbaijan, registration of adoption is carried out based on an extract from the legally effective court resolution on the adoption of a child entered into the information system of the Ministry of Justice of the Republic of Azerbaijan from the “Electronic Court” information system.
  • If the adoption is canceled by the court, after the court resolution enters into legal force, all initial information that was present before the adoption is restored in the record of the act of birth of the adopted child based on an extract from the legally effective court resolution on the cancellation of the adoption entered into the information system of the Ministry of Justice of the Republic of Azerbaijan from the “Electronic Court” information system in accordance with Article 131.4 of the Family Code of the Republic of Azerbaijan.

 

Amount of public duty:

No public duty is paid for registering adoption and issuing initial certificates.

 

Registration of affiliation

The documents required for registration of affiliation are as follows:

  • joint application of the child’s father and mother (parents) for the establishment of paternity
  • identity documents of the applicants
  • child’s birth certificate
  • if paternity is established by court order, a legally effective resolution
  • if the mother has died, is considered incapable, it is impossible to determine the mother’s place of residence, or is deprived of parental rights, the application of the father of the child must be accompanied by:
    • a document confirming the consent of the guardianship and trusteeship authorities
    • a certificate of the mother’s death (copy)
    • an extract from a legally effective court resolution on the recognition of the mother as incapable
    • an extract from a legally effective court resolution on the deprivation of the mother of parental rights
    • an extract from a legally effective court resolution on the recognition of the mother as missing or a document confirming the impossibility of determining her place of residence
  • if paternity is established in respect of an adult person, his/her consent
  • if that person is deemed incapacitated, the consent of his/her guardian or guardianship and conservatorship authority

 

List of persons who must be present during the registration of affiliation:

  • parents (father and mother)
  • upon the application of a single father - the child’s father
  • when paternity is established in court, the parents or one of them
  • when paternity is established in respect of an adult person, that person and the parents
  • when an adult person is deemed incapable - a guardian or custodian
  • authorized persons based on a notarized power of attorney

 

  • The affiliation on the basis of an application shall be registered at the registry office or consular office chosen by the parents, or in the case of paternity established by a court, on the place where the court decision was issued. 
  • With the exception of documents that have lost their legal significance as a result of the state registration of affiliation, if the specified documents can be obtained from the relevant state body (institution) through the Electronic Government Information System, those documents or information shall not be required from the applicant.
  • In cases where such documents or information cannot be obtained through the Electronic Government Information System, their submission shall be requested from the relevant state body (institution) upon request with the consent of the applicant or shall be provided by the applicant.

Amount of public duty:

No public duty shall be paid for the registration of affiliation and the issuance of initial certificates on this matter.

 

Registration of a change of name, patronymic and surname

The documents required for registration of a change of name, patronymic and surname are as follows:

  • Application for change of name, patronymic and surname
  • Birth certificate of the applicant
  • Marriage certificate if the applicant is married
  • Divorce certificate if the applicant is divorced
  • Birth certificate of the children, if the applicant has children
  • Notarized copy of the identity document
  • Notarized copy of the initial military registration certificate or military card
  • 2 photographs of the applicant measuring 3x4 cm
  • Document on payment of public duty 

 

List of persons who must be present during the registration of a change of name, patronymic and surname:

  • the applicant himself
  • authorized persons based on a notarized power of attorney

 

A change of name, patronymic and surname based on an application is subject to state registration at the registry office and consular office chosen by the citizen, and a change based on a court resolution is subject to state registration on the place where the relevant resolution was issued.

 

Amount of public duty:

A public duty of 15 manats must be paid for the registration of a change of name, surname and patronymic.

 

Registration of death

The documents required for registration of death are as follows:

  1. identity document of the deceased
  2. if the deceased is a foreigner or stateless person temporarily or permanently residing in the Republic of Azerbaijan, as well as a refugee, a document confirming the permit for temporary or permanent residence in the Republic of Azerbaijan or refugee cards
  3. if the deceased is a military officer or conscript, a military ticket (documents related to military service).

 

List of persons who must be present during the registration of death:

The registration department registers the death of a deceased person in the territory of the Republic of Azerbaijan on the basis of information transmitted to the information system without the participation of any person during the working day on which that information was transmitted.

 

  • The death is registered in the registry office, consular office and representative office of the executive authority chosen by the person who provided the information, when the fact of death is established by the court, or when the person is declared dead - on the place of the court decision.
  • The state registration of death can be carried out on the basis of an electronic application without visiting the registry office, representative office of the executive authority and consular office. Depending on the person’s desire, the relevant certificate can be printed from the information system of the Ministry of Justice of the Republic of Azerbaijan and certified by the signature of an official and submitted on paper.
  • During electronic registration of death, the electronic certificate is generated in the information system and transmitted to the “MyGov” Electronic Government Portal for placement in the electronic cabinet of the applicant through the Electronic Government Information System.
  • Information about death is transmitted by the medical institution to the Ministry of Health of the Republic of Azerbaijan, and by the Ministry of Health of the Republic of Azerbaijan on the same day through the EHIS to the information system of the Ministry of Justice of the Republic of Azerbaijan and from there in an automated mode to the registration department at the place of death.
  • The registration department registers the death of a person who died in the territory of the Republic of Azerbaijan on the basis of the information transmitted to the information system within the working day of transmission of this information.
  • In the absence of a medical certificate of death, the fact of death is established in court. In this case, in accordance with the Article 194.2 of the Family Code of the Republic of Azerbaijan, the death is registered based on an extract from the legally effective court resolution on the establishment of the fact of death or on the declaration of the person as dead, which was entered into the information system of the Ministry of Justice of the Republic of Azerbaijan from the “Electronic Court” information system.
  • In cases where a citizen of the Republic of Azerbaijan, a stateless person permanently residing in the Republic of Azerbaijan or a foreigner dies in a foreign country and the death is not registered with the competent authorities and consular office of that country, the registration of death is carried out by the registration department on the basis of a medical document confirming the fact of death issued in this country.

Amount of public duty:

No public duty is paid for the registration of death and the issuance of initial certificates on this.

 

Issue of duplicate certificates (references) about registration of civil status acts

Documents required for issuing duplicate certificates (references) about registration of civil status acts:

  • Application (the relative application form can be obtained from the “Application and request forms” section of the Ministry’s official website)
  • identity document of the applicant
  • Documents confirming kinship relations for obtaining a duplicate certificate (reference) for the deceased (certificates (references) of registration of birth, marriage and other civil status acts)
  • Document on payment of public duty

 

  • By checking the compliance of the information in the information system of the Ministry of Justice of the Republic of Azerbaijan with the information in the civil status act records, individuals are issued a duplicate certificate or reference about registration of civil status acts.
  • For the issuance of a duplicate certificate (reference), interested persons apply to the registration department of their choice, the archive of civil status acts, the archive of civil status acts of the Nakhchivan Autonomous Republic, or the consular office where the act record is located.
  • Note that certificates on family members and family status certified by an electronic signature can be obtained in digital form through the “myGov” e-government portal.
  • If it is possible to obtain documents for the issuance of a duplicate certificate (reference) from the relevant state body (institution) through the Electronic Government Information System, those documents or information are not required from the applicant. In cases where it is not possible to obtain such documents or information through the Electronic Government Information System, their submission is required from the relevant state body (institution) upon request with the consent of the applicant or is provided by the applicant.

 

List of persons who must be present when issuing duplicate certificates (references) on registration of civil status acts:

  • the person himself, about whom the relevant civil status act was recorded
  • for minors - their parents, adoptive parents, guardians or guardianship and trusteeship bodies, social service institutions and social protection bodies
  • for the deceased - relatives of the deceased
  • authorized persons on the basis of a notarized power of attorney

 

Amount of public duty:

A public duty of 3 manats is paid for issuing duplicate certificates on registration of civil status acts. No public duty is paid for issuing references on registration of civil status acts.

Making changes to civil status act records and restoring lost act records

List of documents required for making changes to civil status act records and restoring lost act records:

  • Application of the applicant
  • Identity document of the applicant
  • If the changes to civil status act records or their restoration are carried out on the basis of a court decision, the legally effective court resolution
  • Other documents that are the basis for making changes to or restoring civil status act records

 

List of persons who must be present when making changes to civil status act records and restoring lost act records:

    • the person himself/herself about whom the civil status record was drawn up
    • in the case of minors, their parents, guardian or guardianship and trusteeship bodies
    • in the case of a person considered incapable, a person’s guardian 
    • in the case of the deceased, their legal heirs
    • authorized persons based on a notarized power of attorney
  • Amendments to civil status act records based on an application are made by the registration departments and consular offices chosen by the person who submitted the application, if there are sufficient grounds and there is no dispute between the relevant persons, and if by the court decree  -on the place where the resolution was issued on the basis of a court resolution.
  • In the case of a dispute between the relevant persons, amendments to the record are made based on a court resolution.
  • In accordance with the Article 161.4 of the Family Code of the Republic of Azerbaijan, when an extract from a legally effective court resolution on making changes to a civil status act record is received through the “Electronic Court” information system, the necessary changes are made to the copy of the act record kept in the registration departments or consular offices without drawing up an opinion by the registration departments or consular offices.
  • Restoration of civil status act records is carried out by registration departments and consular offices at the location chosen by the applicants on the basis of documents confirming the real existence of such records.
  • If it is impossible to restore the lost act record by registration departments and consular offices, the fact of registration of the civil status act is established in court.
  • If it is impossible to obtain a civil status act record drawn up in a foreign country or information about its existence, registration departments or consular offices restore that act record and issue an appropriate certificate.
  • In accordance with the Article 162.3 of the Family Code of the Republic of Azerbaijan, upon receipt of an extract from a legally effective court resolution on the restoration of civil status act records through the “Electronic Court” information system, the act record is restored without drawing up an opinion by the registration departments or consular offices, and upon application by the interested person, he is issued an appropriate certificate or reference.

 

Amount of public duty:

A public duty of 3 manats must be paid for making changes to civil status act records and issuing certificates related to their restoration.

 

Rule of making change to surname ending

List of documents required for changing the surname ending:

  • A copy of the identity document of the applicant
  • All other certificates issued on the basis of the act records that must be changed

 

List of persons who must be present when changing the surname ending:

  • Every citizen who has reached the age of 18 has the right to apply for changing the surname ending
  • The change of the surname ending of persons under the age of 18 is carried out on the basis of the application of their parents and other legal representatives (adoptive parents, guardian or custodian)
  • Authorized persons on the basis of a notarized power of attorney

Note: The surname ending of a child who has reached the age of 10 can be changed only with his/her consent.

 

Amount of public duty:

There is no public duty for issuing new legal documents related to changing the surname ending.

In what cases can the period for registering a marriage be reduced?

In case of good reasons (urgent long-term business trip or moving to another place for permanent residence, having joint children, pregnancy of the woman wishing to enter into marriage, serious illness of the spouses or their close relatives, conscription into military service and other cases), the term of marriage may be reduced or extended by the registry office or the representative office of the executive authority for a period not exceeding 1 month. If the persons wishing to enter into marriage have common children, if both of them are over 50 years old, as well as if the woman is pregnant, the marriage registration may be carried out on the day of submission of the application.

What is a marriage contract and how is it concluded?

A marriage contract is an agreement concluded between the persons entering into marriage, which determines the property rights and obligations of the spouses during the marriage and in the event of its dissolution. A marriage contract may be concluded at any time before the state registration of the marriage, as well as during the marriage. A marriage contract concluded before the state registration of the marriage shall enter into force on the day of the state registration of the marriage. A marriage contract shall be concluded in writing and shall be notarized.

How should a marriage be dissolved based on resolutions of foreign courts be made?

Resolutions of foreign courts (except for courts of CIS member countries) on the dissolution of marriage are enforced after being recognized by the Supreme Court of the Republic of Azerbaijan.

In what cases is it not possible to change the name, patronymic and surname?

Changing the name, patronymic, or surname of the applicant is not permitted during the period when he/she is involved in criminal proceedings as a suspect or accused, if he/she has an unexpunged or unpaid conviction, or if he/she is a person against whom compulsory medical measures have been applied.

How is death registered?

Information about death is transmitted by the medical institution to the Ministry of Health of the Republic of Azerbaijan, and by the Ministry of Health of the Republic of Azerbaijan on the same day through the EHIS to the information system of the Ministry of Justice of the Republic of Azerbaijan and from there in an automated mode to the registration department at the place of death. The registration department registers the death of a person who died in the territory of the Republic of Azerbaijan on the basis of the information transmitted to the information system within the working day of the transmission of that information.

Is marriage possible if there are kinship ties?

According to Article 12 of the Family Code of the Republic of Azerbaijan, marriage is not allowed between close relatives (parents and children, grandparents and grandchildren, natural and stepbrothers and sisters (having a common father and mother), adopters and adopted children. At the same time, by Law No. 1198-VIQD dated June 28, 2024, provisions were added to Article 12 of the Code on the prohibition of marriage between children of brothers and (or) sisters who have a common biological grandfather and (or) grandmother, as well as biological relatives of uncles and nieces, as well as aunts and nephews, and this amendment came into force on July 1, 2025.
