The Ministry of Justice prepares draft legislative acts, provides opinions on drafts, maintains the State Register of Legal Acts of the Republic of Azerbaijan, and conducts mandatory legal review of normative legal acts of central executive authorities and acts of normative nature (except for decisions of the Constitutional Court of the Republic of Azerbaijan).
This activity is carried out by the Department General for Legislation of the Ministry of Justice.
The activities of the Ministry in the field of legislation include:
• preparation of draft normative legal acts to ensure alignment of existing legislation with newly adopted legislative acts;
• providing legal opinions on the compliance of draft legal acts and draft international treaties with the Constitution and legislation of the Republic of Azerbaijan;
• maintaining the State Register of Legal Acts and conducting mandatory legal review of legal acts submitted for inclusion in the Register, in cases specified by legislation;
• preparation of the new draft legal acts within the framework of the implementation of state programs, strategies, action plans, and instructions of the leadership;
• providing legal opinions and proposals on requests submitted by state bodies and institutions;
• participating in the provision of opinions on issues relating to the legal force of international treaties, as well as other matters concerning their entry into force and implementation;
• participating in the preparation of periodic reports submitted by the Republic of Azerbaijan to international organizations regarding the implementation of obligations arising from international treaties;
• maintaining a unified internet information resource of legal acts;
• providing explanations on legislation upon requests from legal entities and individuals;
• raising issues before the relevant authorities (institutions) on the repeal or amendment of acts of normative nature (except for decisions of the Constitutional Court of the Republic of Azerbaijan) and normative legal acts of central executive authorities that do not comply with the Constitution and laws of the Republic of Azerbaijan.

According to Article 85.1 of the Constitutional Law “On Normative Legal Acts”, laws, decrees and decisions of the Cabinet of Ministers shall enter into force from the date of their official publication, unless a later date of entry into force is provided for in those acts. If a longer period is not specified in the interstate treaties to which the Republic of Azerbaijan is a party, the normative legal act regulating foreign trade activity shall indicate that it shall enter into force at least 30 days after the date of its publication. In exceptional cases, provided that international organizations are immediately informed, a normative legal act regulating foreign trade activity may enter into force within the period specified therein. Normative legal acts of central executive authorities shall enter into force from the date of their publication in the electronic version of the State Register of Legal Acts, unless a later date of entry into force is provided for in those acts.

According to paragraph 5.1 of the “Regulation on the Rules for Including Legal Acts in the State Register of Legal Acts of the Republic of Azerbaijan” approved by the Decree No. 463 of the President of the Republic of Azerbaijan dated July 1, 2011, when information is obtained on the application of legal acts not included in the State Register of Legal Acts by central executive authorities and bodies (institutions) adopting acts of normative nature (except for decisions of the Constitutional Court of the Republic of Azerbaijan), the Ministry of Justice shall request the bodies (institutions) that adopted these acts to submit them for inclusion in the State Register of Legal Acts. If this request is not fulfilled within ten working days, the Ministry of Justice shall publish information on the invalidity of legal acts applied without being included in the State Register of Legal Acts, as well as those not annulled within five days, in the online information resource of the State Register of Legal Acts.
When ambiguities and differences in the content of a normative legal act, as well as contradictions in the practice of its application, are discovered, the normative body that adopted that act or, in accordance with Part IV of Article 130 of the Constitution of the Republic of Azerbaijan, the Constitutional Court of the Republic of Azerbaijan officially interprets the relevant norms.
