Competition for engaging in notarial activities

Who can participate in the competition to become a notary?

A citizen of the Republic of Azerbaijan with a higher legal education, at least 3 years of work experience in the specialty of a lawyer, moral qualities and professional knowledge can become a notary.

A citizen of the Republic of Azerbaijan with a higher legal education, at least 3 years of work experience in the legal field, moral qualities and professional knowledge may become a notary.
According to Article 3 of the Law of the Republic of Azerbaijan “On Notary”, a person who has dual citizenship, has obligations to other states, religious officials, persons who have been dismissed from work for violating the requirements of the legislation in connection with the performance of their duties, persons who have been declared legally incapable or have limited legal capacity in accordance with the procedure established by law, persons who have previously committed a crime and have been convicted thereof, persons who have been subject to a legally effective court decision restricting notarial activities or ordering the application of compulsory medical measures, as well as persons who are unable to work as notaries due to physical or mental disorders based on a legally effective medical opinion, as well as persons who have a legally effective decision of an investigative body or court on the termination of a criminal case concerning the commission of a crime on non-exculpatory grounds, and persons who have reached the age of 65 may not become a notary.

What are the stages of the competition?

The competition consists of a test examination, interview and mandatory training stages. At the end of the mandatory training, a certificate is issued in order to engage professionally in notarial activities based on the results of the assessment.

What documents are required to participate in the competition?

1.    Notarized copy of the identity card;
2.    Personal record form of the candidate;
3.    Curriculum vitae;
4.    Notarized copy of the document (diploma) on higher legal education (with recognition of qualifications of foreign countries related to higher education);
5.    Notarized copy of the military ID card or a document replacing it, a document confirming the completion of military service and registration issued by the relevant local department, division, or unit of the State Service for Mobilization and Conscription of the Republic of Azerbaijan, and a relevant document confirming the right to deferment from conscription or exemption from military service;
6.    a certified copy of the employment record book (notarized or certified by HR) if employed;
7.    Service reference (for employees);
8.    a certificate from the Medical Department General on physical and mental health;
9.    two color photographs measuring 4x6 cm, and, two color photographs measuring 3x4 cm (on a white background).

What is a Specialization Commission?

A Specialization Commission consisting of 7 members is established by the Ministry to assess the level of knowledge of persons seeking to obtain a certificate to engage professionally in notarial activities and to become assistants to private notary through an examination and interview, to conduct interviews on professional training in notarial activities, and to resolve issues related to the issuance of certificates, proposals for appointments, or refusal to issue certificates.
