Competition to engage in notarial activities

Who can participate in the competition to become a notary?

A citizen of the Republic of Azerbaijan with a higher legal education, at least 3 years of work experience in the specialty of a lawyer, moral qualities and professional knowledge can become a notary.

According to Article 3 of the Law of the Republic of Azerbaijan “On Notary”, a person who has dual citizenship, has obligations to other states, a religious figure, has been dismissed from work for violating the requirements of the legislation in connection with the performance of his duties, has been considered incapable or limited in capacity in accordance with the procedure established by law, has previously committed a crime and has been convicted for it, has been issued a legally effective court decision on restriction of notarial activities or application of compulsory medical measures, as well as a legally effective medical opinion of an investigative body or court on termination of a criminal case on the commission of a crime without exculpatory grounds, is unable to work as a notary due to physical and mental disorders, and has reached the age of 65 cannot become a notary.

What are the stages of the competition?

The competition consists of a test exam, interview and compulsory training stages. At the end of the compulsory training, a certificate is issued to professionally engage in notarial activities based on the results of the assessment.

What documents are required to participate in the competition?

1.    Notarized copy of the identity card;

2.    Personal personnel record sheet;

3.    Curriculum vitae;

4.    Notarized copy of the document (diploma) on higher legal education (with recognition of qualifications of foreign countries related to higher education);

5.    Notarized copy of the military ID card or its replacement document, a relevant confirmation document on the completion and registration of actual military service from the local department, department and unit of the State Service for Mobilization and Conscription of the Republic of Azerbaijan, if there is a right to a deferral from conscription for fixed-term active military service or if exempted;

6.    a certified copy of the employment record book (notarized or by the personnel service) when engaged in labor activity;

7.    a service record (for employees);

8.    a certificate from the Ministry's medical service on physical and mental health;

9.    2 color photographs measuring 4x6 cm and 2 color photographs measuring 3x4 cm (on a white background).

What is a specialization commission?

A specialization commission consisting of 7 people is established by the Ministry to check the knowledge level of a person who wants to receive a certificate to engage in notarial activities professionally and to become an assistant to a private notary through an exam and interview, to conduct an interview on professional training in notarial activities, to issue a certificate and proposals for appointments or to resolve issues related to the refusal to issue a certificate.
