The Ministry of Justice gives great importance to enlargement of the international legal cooperation within the frame of progressive legal reforms made under the leadership of the President Ilham Aliyev.
So, the ministry realizes the execution of more than 40 bilateral contracts, as well as legal aid for criminal and civil cases, extradition and the obligations on convicted persons, cooperates within the frame of bilateral contracts with the ministries of justice of 32 countries, acts as a central or coordinating body on 16 multilateral conventions. As a result of it, the number of inquiries entered into the ministry about international legal aid raised to 19.000.
The works in the field of extradition, which is one of the ancient institutions of international criminal law, are enlarged within the frame of legal cooperation. So, there were concluded contracts in this field with some countries, as well as with China, Iran, Morocco, United Arab Emirates, Jordan, India, as well as with Algeria
this year. Cooperation on relative conventions within the frame of CIS countries is realized.
At the same time, our country being the participator of the European Convention “About Extradition” on 1957 as a competent organization by the ministry of Justice carries out effective relations with the continent states. These documents attain the important significance from the point of view of prevention of criminality, calling to account the persons who committed crime and herewith provision of justice judgement. Besides it, the state of Azerbaijan not only is satisfied with honest realization of duties coming from the universal and regional conventions, and also adopted special law about extradition by demonstrating good intention and this gives opportunity to make cooperation with our foreign supporters without a contract. All these, being very important effective mechanism which prevents the offenders from feeling themselves in danger, provide inevitability principle of the crime. It is not accidentally that, the extradition of offenders from Spain and Algeria is realized within the frame of execution of mentioned documents.
Last years, it is paid special attention to protection of the rights of the persons transferred during extradition, provision of arresting conditions in the penitentiary institution and medical control in accordance with the European standards. Even there is a practice that, the decision about extradition of the person is given only after being acquainted with the keeping in the state receiving him.
There were made purposeful measures in the field of modernization of penitentiary system and infrastructure under the leadership of the President Ilham Aliyev, improvement of keeping conditions of the prisoners and medical and other conditions and in the field of appliance of effective public control. It is a positive result of the reforms made in this field that, Germany by using the mentioned practice made a decision about extradition of Azerbaijan citizen accused by the article 120.1 (intentional homicide) of the Criminal Code and he was extradited to our country from Germany by the Ministry of Justice.
Generally, there was achieved to extradite about 160 offenders to Azerbaijan during the last 5 years.
The necessary measures will be continued in this field thereafter.
