There was held a large conference dedicated to the execution of the decisions of the courts and other authorities, as well as execution of punishments not related to deprivation of liberty, discussion of works and forthcoming duties against justice judgement and in the field of investigation of some other crimes in the Ministry of Justice in 2018 by presence of the heads of all local organizations of executive and probation services, as well as relative departments of the ministry and investigators conducting primary investigation on criminal cases.
Vice-minister of justice Vilayat Zahirov making an opening speech in the event stressed the all-round progress and high achievements of our republic in 2018 gained under the leadership of the President Ilham Aliyev, told about systematic reforms on modernization of justice activity, works carried out for increase of efficiency of justice judgement, in the field of execution of court decisions about humanization of punishment policy and alternative punishments for deprivation of liberty, as well as about results gained during a short period by working group established in the Head Executive Office on preparation of the project “Executive Code of the Republic of Azerbaijan”.
Then, the chief of the Head Executive Office – senior executive officer Nuraddin Mustafayev, the chief of the Probation service – senior probation officer Akshin Ziyadov and the chief of the Investigation Department Zakir Gafarov spoke with report lecture.
It was informed that, as a display of belief of the population in the courts, the volume of the works in the field of execution of court decisions is reasonably increased by rise of the number of the cases considered by the courts recent years. So, in 2018 the number of the executive cases entered into the executive organizations was raised to 873 thousands, more than 450 thousands of them were executed and the rest of them are under execution. As a result of the realized measures, the legal and physical persons were paid 1.1 milliard manats – twice more in comparison with the last year.
6.775 persons, who deviated from the execution of decisions, were called to administrative account, as well as 2.913 persons were arrested by the courts in administrative form, there was begun criminal case about 446 persons. 4.885 persons, who were limited to leave the country, executed the court decision and limitation was removed.
The number of uses of electron service established by the ministry for convenience of the citizens and allowing learning immediately about such limitations rose to 1.4 million in 2018.
As well as, there was given information about the works realized in the field of execution of punishments not related to the deprivation of liberty. It was noted that, approximately the half of the prisoners registered by local probation organizations – 10.182 persons were deregistered with relate to completion of term of punishment, full execution of assigned punishment or under other bases defined by the law. Punishment of 527 prisoners, who deviated from execution of punishment, was substituted for another type of punishment, as well as punishment of 46 persons was replaced with deprivation of liberty.
There were realized considerable works with relate to effective organization of the case in the level of modern requirements during the financial period by the Probation service established by the Order of the President about humanization of punishment policy on February 10, 2017. Electron control means began to be applied in execution of alternative punishments for deprivation of liberty. For this purpose there was established Electron monitoring centre in Probation service supplied with modern equipment and allowing pursuing the prisoners continuously and making operative contacts. 605 persons sentenced to alternative punishments for deprivation of liberty and sentenced to the punishment of deprivation of liberty were applied electron bangles, and bangles were taken off from some prisoners completing punishment term and on other legal bases.
According to the commissions mentioned in the Order of the head of state, there were carried out practical works with relate to prevention of punishment’s formal execution practice last year and realization of effective control over its execution, as well as legislation was improved, more effective mutual activity was established with the local executive power authorities, the list of the workplaces for executive works and the number of persons required for relative works was defined, and the responsibility of the officers for non-implementation of the relative duties was increased.
According to the court decisions, 1.030 persons were involved in execution of punishment in the type of public works and in execution of administrative reproof in 2018, and 603 of them were deregistered with relate to completion of the term of public works. The amount of the means paid to the state budget with relate to execution of penalties and punishments on correctional works raised over 2.5 million increasing by 70 percent.
At the same time, more than 1200 persons, registered in the probation service as a result of decriminalization of some deeds, were released from sentence by the courts or punishment term was decreased by the Law about humanization of punishment policy on October 17, 2017.
Primary investigation of 673 criminal cases from 1.078 under the execution of the Investigation department during the report period was completed, 276 of them
related to the persons deviated from payment of alimony, and the investigations achieved payment of losses in the amount of 1.9 million manats made to the physical and legal persons.
Besides the measures, also defects and shortcomings were noted at the meeting, the officials of the ministry and the heads of the local executive authorities were listened with relate to existing problems, the ways of elimination of the causes and conditions of shortcomings were analysed in detail.
Vice-minister summarizing the conference, gave commissions with relate to provision of timely and exact execution of the court decisions playing an important role in realization of justice judgement and the alternative punishments for deprivation of liberty, paying attention to exact and effective execution of the activity form defined by the courts, enlargement of appliance of “Electron execution” information system and “Electron document circulation”, strengthening of control over the activity of the subordinate organizations, as well as improvement of investigation works.
At the same time, there were defined additional measures about increase of efficiency of public works and other types of punishment, improvement of educational works for the persons sentenced to alternative punishments for deprivation of liberty, prevention of cases of deprivation from imprisonment, and also there was stressed the importance of agitation of voluntariness institute in the executive and probation organizations, careful and sensible approach towards the citizens’ appeals, banning of cases causing corruption and steady compliance with the ethical behavior rules.
