There was held a large conference at the Ministry of Justice dedicated to the execution of the decisions of the courts and other authorities, as well as discussion of works realized in the field of probation control by the executive and probation services in 2019 and forthcoming duties by presence of the heads of all local organizations of executive and probation services.

Vice-minister of justice Vilayat Zahirov making an opening speech in the event stressed the all-round progress and high achievements of our republic in 2019 gained under the leadership of the President Ilham Aliyev, told about reforms in the field of justice and judiciary, informed about the works carried out on execution of the Presidential Decree on 03.04.2019 “On deepening of the reforms in the judicial-legal system”, which is an important “road map” in this field, and stated that forthcoming duties were completed accurately and fully.

Then, the chief of the Head Executive Office – senior executive officer Nuraddin Mustafayev, the chief of the Probation service – senior probation officer Akshin Ziyadov spoke with report lectures.

It was informed that, last year a workload was great in the field of execution of court decisions, which is one of the important functions of the Ministry of Justice. So, in 2019 the number of the executive cases entered into the executive organizations was raised to 861 thousands, more than 485 thousands of them were executed, the legal and physical persons were paid 1.74 milliard manats – more than 50% in comparison with the last year, and 143 million manats of this are alimony payments. Measures on execution of the rest of cases are continued.

4.712 persons, who prevented from executing the decisions and did not meet the legal requirements, were called to administrative account, as well as 2.808 persons were arrested in administrative form, there was begun criminal case about 493 persons, who deviated from execution of court decisions intentionally.

Also, the experience of temporary restriction of the right to leave the country has had a positive impact on enforcement of court decisions, as more than 13 thousand debtors have executed court decisions, the limitation has been removed. The number of uses of electron service established by the ministry for learning about presence or absence of such limitations rose to 1.5 million in 2019.

As well as, there was given information about the works realized in the field of execution of punishments not related to the deprivation of liberty. It was noted that, the measures taken within the execution of the Decree of the President of the country on humanization of the punishment policy signed on February 10, 2017 have been very fruitful. As a result of the courts' preference for alternative sentences for imprisonment, the number of convicts registered with local probation bodies increased by 7.5 percent last year and reached to 23,000, compared to the previous year. The number of people sentenced to imprisonment increased by 4.4 times compared to 2018.

9,727 persons registered with local probation agencies were de-registered in connection with the expiration of their sentences last year, the full execution of the sentence or other grounds specified by law, the courts have replaced the punishment of 728 convicts, who evaded execution of the sentence, by another type of punishment, including the punishment of 120 people by imprisonment.

At the same time, the use of electronic controls in the execution of alternative punishments for deprivation of liberty, including limitation of liberty, significantly expanded, and in 2019, more than 2,400 prisoners were provided with electronic bangles.

In 2019, according to the court's decisions, 1,502 people were involved in punishments like public activities and administrative penalties, of which 886 were de-registered due to expiration of public works. During the year, more than 183,000 hours of community service was provided for the execution of this type of punishment and administrative offence. About 2.5 million manats were paid to the state budget for execution of penalties and reformatory works.

In addition to the works done at the meeting, shortcomings and defects were noted, in this regard the officials of the Ministry, heads of local executive and probation agencies were listened, the reasons causing problems were analysed and specific requirements were put for their elimination.

Summing up the meeting, the Vice-Minister drew attention to the unprecedented struggle against corruption offenses in our country and noted that such actions were strictly and severely punished, and that the disciplinary and other legal measures taken during the reporting period are a good example of this. He said that, 31 local executive and probation officers were brought to disciplinary responsibility, 5 of them were expelled from the judiciary, including 2 individuals were sent to the prosecutor's office for legal evaluation.

In addition, necessary instructions were given on implementation of duties specified by the law on activity directions of both services, responsible and sensitive approach to citizens’ and legal entities’ appeals, compliance with ethical rules of conduct, and involvement of young volunteers in justice activity during the current year – announced “A year of volunteers” according to the relative Presidential Order.
