There was held a conference in the Ministry of Justice on the discussion of the execution of court and other bodies’ decisions, including forthcoming duties and works realized in the first half-year of 2019 in the field of provision of activity form defined by the court.
Vice-minister of Justice Vilayat Zahirov, making an opening speech in the event, gave information about the measures realized in accordance with the commissions of the President Mr. Ilham Aliyev on increase of efficiency of justice judgement, and noted the works made on activity of the executive service according to the Decree of the head of state “On deepening of the reforms in the judicial-legal system” on April 3, 2019.
He noted that, there were made concrete measures on enlargement of application of “Electron execution” information system, prevention of procrastination and abuse cases with relate to execution of the commissions specified by the Decree, the legislation was improved, as well as the project of the Executive Code was prepared, and relative offers were made with relate to alternative mechanisms of execution and commitment of execution to private organizations by learning advanced international experience.
Then, the chief of the General Department of Bailiffs – general executive officer Nuraddin Mustafayev spoke with a report lecture.
He noted that, the volume of works in the field of execution of court decisions in recent years was reasonably raised. In the first half-year of 2019, the number of executive cases entered the executive organizations reached to 731,000, more than 384,000 of them were executed and measures are being continued on execution of the rest of cases. As a result of made measures, legal and physical persons paid assets in the amount of more than 300 million – more than 50% in comparison to the previous period.
1.954 persons, who did not implement the legal demands of the executive officers, were involved in administrative responsibility, as well as 1.421 persons were imprisoned by the courts in administrative form, and criminal case was raised about 301 persons, who evaded executing court decisions. During the reporting period, the right of leaving country for 2.496 debtors was limited provisionally, limitations imposed on 8.210 persons previously, were taken off for executing court decision, and this is 4 times more in comparison with the last periods.
It should be noted that, the number of e-services rendered by the ministry to citizens in the first half of 2019 increased to about 1 million in order to find out whether such restrictions were available.
In addition to the works done in the session, deficiencies and shortcomings were noted, officials of the Executive Service were heard on the existing problems, and the ways of eliminating the causes and conditions of the shortcomings were thoroughly analyzed.
Summing up the meeting, the Vice-minister gave concrete commitments on timely and honest execution of court decisions playing an important role in provision of the rights of citizens, enhancing control over entrepreneurship activities and alimony, increasing the attention of the courts to the effective functioning of the established procedures, development of appliance of “Electron execution” information system and “Electron documentary circulation".
It was also emphasized that the most important task of executive officers is to increase the control over the activities of the local executive services, to improve the professionalism of the executive officers, to properly serve citizens and to approach their addresses appropriately, to abide by ethical conduct and to prevent the occurrence of corruption.
