The number of court decisions and acts of other bodies, which are an integral part of justice and are binding, is growing every year. In the first six months of this year alone, the number of works to be performed in the country increased by 19 percent and exceeded 850,000. The fact that the implementation of these documents covers a large part of the country's population significantly increases the importance of their implementation.
In accordance with the instructions of President Mr. Ilham Aliyev, the Ministry of Justice is taking consistent measures to increase the efficiency of executive activities, including the structure of the executive service was improved and the material and technical base was strengthened.
In order to discuss the works done in this area and the tasks ahead, the ministry held a video conference with the participation of the leadership and officials of the executive service.
Opening the event, Vice-Minister of Justice Mr. Eldar Nuriyev noted the comprehensive progress made under the leadership of the President Mr. Ilham Aliyev, successful reforms in the judicial sphere, increase of the efficiency of justice, as well as measures taken to improve the implementation of decisions.
Mr. Ilgar Jafarov, Chief of the General Department of Bailiffs – Chief Executive Officer of the Ministry, made a report, noting that effective measures were taken to improve the implementation of decisions in connection with the heavy workload of the service, the legislation was improved, the powers of executive officers were expanded, new modern mechanisms were introduced.
Also, it was noted that, the application of modern information and communication technologies plays an important role in ensuring efficiency and transparency in the activities of executive bodies, the "Electronic Execution" information system, which has been operating for five years, significantly increases the efficiency of the work. It was noted that the integration of this system into the databases of various agencies has a positive effect on the immediate acquisition of necessary documents, including information about debtors, thus preventing the loss of additional time.
It was noted at the meeting that monitoring the progress of enforcement proceedings, obtaining information on enforcement measures, making alimony and other enforcement payments to debtors online or through terminals, creating the opportunity of automated release of restrictions on the right to leave the country by paying debts through the "electronic justice" kiosk, serve the comfort of the people. This year alone, the number of users of the ministry's e-service "Information on the restriction of the debtor's right to leave the country" has reached 115,000.
It was also noted that the necessary works have been done to improve the legislative framework in the field of enforcement, the work on the draft "Executive Code of the Republic of Azerbaijan" has been completed.
As a result of effective measures taken in the field of enforcement, there is an increase in the number of enforcement cases. Thus, in the first half of this year, the number of executive documents, executed or under execution, increased by more than 13% and reached 350,000. At the same time, about 60,000 enforcement cases have been completed every month this year on alimony claims, one of which is directly related to the rights of children and belongs to the category of alimony.
Individuals and legal entities were made to pay up to 300 million manat, including about 37 million manat for alimony.
More than 6,700 enforcement actions on the requirement to use of parental rights - to communicate with the child were provided on a regular basis, and in connection with the current pandemic situation, citizens also had the opportunity to meet in video conference format.
It was noted at the event that the executive bodies regularly take necessary enforcement measures to ensure timely enforcement, but the debtors are biased in the execution, and sometimes indifferent to the payment of alimony. It was noted that regular awareness-raising activities were carried out on the executive activity as a whole.
At the same time, serious measures have been taken to prevent evasion of execution, in 2021, 2,800 people who committed such cases were brought to administrative responsibility, and criminal proceedings were instituted against 244 debtors. The right to leave the country of 1,562 debtors, who prejudicially evaded the execution, was temporarily restricted, and 1,245 people who executed the court decision were removed from their previous restrictions.
In addition to the works done, the shortcomings and defects were noted at the meeting, officials of the ministry were heard in this regard, the causes and conditions of the problems were analysed and ways to eliminate them were discussed. Expressing concern over the legitimate complaints received from citizens, including the hotlines, measures have been identified to increase attention to this issue.
Summing up the meeting, Vice-Minister E.Nuriyev stressed the importance of improving the work of the executive service in accordance with the requirements of the President, increasing citizen satisfaction, adherence to the law, the rules of ethical conduct, strengthening the requirements and control over the activities of subordinate bodies. He gave specific instructions on the promotion of the implementation of court decisions and other issues.
