Admission to Service for the Position of State Enforcement Officer

Who is a State Enforcement Officer?

A state enforcement officer is an official who serves in local enforcement bodies subordinate to the Ministry of Justice, holds a special rank, and ensures the compulsory execution of decisions issued by courts and other bodies. A state enforcement officer is regarded as a justice servant, and his/her activity is considered a special type of civil service. The Ministry of Justice supervises the activities of state enforcement officers. In addition, the head of the enforcement body and the court that issues the enforcement document also exercise certain supervisory powers.

What are the Requirements for Becoming a State Enforcement Officer?

Citizens of the Republic of Azerbaijan who meet the requirements for service in justice bodies and possess higher education in any field can become state enforcement officers. A legal education is not required for this position. Both individuals with legal education and those with other higher education qualifications may be appointed as state enforcement officers.

Who Cannot Become a State Enforcement Officer?

According to Article 4.2 of the Law of the Republic of Azerbaijan “On Service in Justice Bodies”,  the following persons may not be admitted to service in justice bodies:


•    persons holding dual citizenship or having obligations to another states; 
•    religious officials; 
•    persons recognized by a court as legally incapacitated or having limited legal capacity; 
•    persons previously convicted of a crime, as well as persons whose criminal proceedings were terminated on non-exculpatory grounds; 
•    persons deemed unfit for service in justice bodies due to physical or mental disorders, based on a medical opinion; 
•    persons dismissed from courts, the prosecutor’s office, justice bodies, other law enforcement agencies, or other state bodies for gross misconduct or actions incompatible with service in such bodies.

How is the Position of State Enforcement Officer Filled?

The position of state enforcement officer is filled through a competitive selection process consisting of a test examination and an interview.
Candidates who successfully pass the competition are required to participate in a mandatory training program at the Academy of Justice for a period of at least three months. Candidates who successfully complete the mandatory training are appointed to the position of state enforcement officer.
Whenever a vacancy arises, the Ministry of Justice announces the competition through its official website, social media accounts, and other media outlets. The announcement provides detailed information regarding the application procedure. Individuals wishing to become state enforcement officers may apply in accordance with the procedure specified in the announcement.

Who is Exempt from the Test Examination Stage of the Competition?

Pursuant to paragraphs 1.7.1–1.7.4 of the “Regulation on the Rules for Conducting Competitions and Interviews with Candidates for Admission to Service in Justice Bodies”, approved by Decree No. 673 of the President of the Republic of Azerbaijan dated 13 December 2007, the following persons are exempt from the test examination stage:


•    persons serving in positions within the prosecutor’s office and other law enforcement agencies that are subject to either special or military ranks; 
•    persons holding administrative positions in other state bodies, who are civil servants; 
•    holders of a Doctor of Laws degree; 
•    persons who have previously served as judges. 

In What Order Are Candidates Appointed Based on the Results of the Competition?

According to paragraph 4.13 of the “Rules for Conducting Competitions and Mandatory Training for Admission to Service of State Enforcement Officers in the Ministry of Justice of the Republic of Azerbaijan”, candidates who successfully pass the final assessment of the mandatory training program are ranked according to the total score obtained from both the competition and the mandatory training.


Based on this ranking, the list of candidates is submitted to the Minister of Justice for appointment to vacant state enforcement officer positions.


Where candidates obtain an equal number of points, preference is given to those who:

•    Hold successive academic degrees; 
•    Have completed a higher level of higher education; 
•    Where the level of education is the same, candidates who have graduated from a higher education institution with honors; and 
•    Possess knowledge of a foreign language. 


According to paragraph 5.2 of Rules, if the number of candidates who successfully pass the final assessment exceeds the number of available vacancies, candidates who are not immediately appointed are included in a reserve personnel list and may be appointed when vacancies arise.
Candidates who refuse a proposed vacant position twice (provided that the same position is not offered more than once) are removed from the reserve personnel list.
